QuixiCloud Copyright, DMCA & Abuse Reporting Policy

1. Purpose
QuixiCloud Data Storage Private Limited ("QuixiCloud") respects the intellectual property rights of others and is firmly committed to maintaining a safe, secure cloud storage platform. This policy explains how users and third parties can report copyright infringement or platform abuse, how QuixiCloud investigates these reports, and the potential enforcement actions we may take.
2. Scope
This policy applies to all services within the QuixiCloud ecosystem, including:
- The QuixiCloud Web Platform
- Publicly Shared Links
- QuixiCloud Android and Windows Applications
- WebDAV connections and APIs
- Any future QuixiCloud client applications
3. Reportable Content
You may submit a report if you encounter content stored on or shared via QuixiCloud that involves:
Copyright Infringement: Unauthorized sharing of copyrighted works, including movies, music, software, documents, images, videos, and books.
Malware & Harmful Code: Ransomware, viruses, worms, trojans, spyware, or scripts designed to damage hardware or steal data.
Phishing & Fraud: Fake login pages, credential theft mechanisms, banking fraud, or identity theft materials.
Spam: Mass unsolicited files, bulk distribution of scam material, or deceptive marketing.
Illegal Content: Content strictly prohibited by applicable law, including:
- Child Sexual Abuse Material (CSAM)
- Terrorist recruitment or propaganda material
- Human trafficking coordination
- Illegal drug trafficking where applicable
Other Platform Abuse: Account compromise, storage quota abuse, network/API abuse, or the unauthorized sharing of credentials intended to circumvent service limits.
4. Reporting Abuse
To report non-copyright abuse (e.g., malware, phishing, or illegal content), please provide:
- The exact QuixiCloud Shared Link URL (if available).
- The specific File ID (if available).
- A description of the abusive behavior or content.
- Supporting evidence (e.g., screenshots or analysis).
Note: Knowingly submitting false or malicious abuse reports may themselves constitute a violation of our Acceptable Use Policy.
5. Copyright Notices (DMCA)
If you believe your copyrighted work has been uploaded or shared on QuixiCloud without authorization, you must submit a formal takedown notice. Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, and the exact QuixiCloud Shared Link URL where it can be found.
- Your contact information (name, address, telephone number, and email).
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Investigation Process
Upon receiving a valid report, QuixiCloud may:
- Review the available metadata associated with the account or file.
- Review the reported public Shared Links.
- Contact the user who uploaded the material.
- Request additional information from the reporter.
- Temporarily disable access to the reported link while investigating.
- Preserve digital evidence where explicitly required by law enforcement.
Due to our encryption architecture, investigations are generally conducted using account metadata and public link access, strictly respecting user privacy.
7. Enforcement Actions
Following an investigation, QuixiCloud may take actions including, but not limited to:
- No Action: If the report cannot be substantiated or lacks sufficient evidence.
- Warning: Issuing a formal warning to the account holder.
- Link Removal: Permanently disabling the infringing Shared Link.
- Temporary Restriction: Restricting specific account features (e.g., disabling public sharing).
- Account Suspension or Termination: Permanently banning the user from the platform.
- Law Enforcement: Reporting the activity to authorities where legally mandated (e.g., for CSAM).
Enforcement decisions are based on the severity of the violation, the available evidence, and applicable law.
8. Repeat Infringer Policy
In accordance with applicable intellectual property laws, QuixiCloud maintains a strict repeat infringer policy. Accounts that repeatedly infringe copyrights, or repeatedly violate this policy, will be permanently terminated without a refund.
9. Counter-Notification
If a user believes their content or Shared Link was removed in error due to a copyright notice, they may submit a counter-notification. The counter-notification must contain:
- The user's physical or electronic signature.
- Identification of the material that was removed and the location where it previously appeared.
- A statement under penalty of perjury that the user has a good faith belief that the material was removed as a result of a mistake or misidentification.
- The user's name, address, telephone number, and a consent statement regarding applicable legal jurisdiction and service of process.
QuixiCloud will review the counter-submission and may restore the material unless the original reporter files a court action.
10. Privacy During Investigations
QuixiCloud handles all abuse reports in strict accordance with our Privacy Policy. Only information reasonably necessary to investigate and resolve the report will be processed, and the identity of the reporter is generally kept confidential unless disclosure is required by law.
11. Good Faith Reporting
Users and third parties should only submit reports they genuinely believe to be accurate. Knowingly false, automated, or retaliatory reports may result in enforcement action against the reporting account and potential legal liability.
